Privacy Policy

LearnNearby, LLC ("LearnNearby," "we," "us," or "our") operates the LearnNearby platform at learnnearby.com and related services (collectively, the "Services"), which connects local instructors ("Instructors") with learners ("Learners") in the San Francisco Bay Area for in-person classes.
This Privacy Policy explains what information we collect, how we use and share it, and the rights and choices available to you. By using the Services, you agree to the practices described below. If you do not agree, please do not use the Services.
Data controller.For purposes of applicable privacy law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the data controller for personal information collected through the LearnNearby platform is LearnNearby LLC, a California limited liability company. LearnNearby LLC operates the LearnNearby platform and may operate additional consumer-facing services under registered DBA brand names (see Section 3.7 below). All rights requests and privacy inquiries are handled centrally by LearnNearby LLC regardless of which brand's services you use.
LearnNearby LLC may in the future change its legal name (for example, to reflect an umbrella brand identity). Any such rename does not change the identity of the data controller for data collected prior to the rename, and does not diminish your rights under this Policy or applicable law. We will update this Policy to reflect any legal name change and notify you accordingly.
1. Information We Collect
1.1 Information You Provide to Us
- Account information: Name, email address, password, phone number, and date of birth (to confirm you meet age requirements).
- Profile information:Profile photo, bio, neighborhood or general location, interests, and — for Instructors — credentials, teaching history, business name, and tax information required for payments (e.g., W-9 information collected by our payment processor).
- Booking and transaction information:Classes you book, attend, host, or cancel; payment card information (collected and processed directly by our payment processor — see Section 3); refund and dispute information.
- Communications: Messages you send through the Services to other users or to LearnNearby support, including content of in-platform messages, reviews, and ratings.
- Content you submit: Class listings, photos, reviews, ratings, and other content you post to the Services.
- Information about minors:If you book a class on behalf of a minor child, we may collect the child's first name, age or grade level, and any allergies or accommodations the Instructor needs to safely deliver the class. See Section 8 (Children's Privacy).
1.2 Information Collected Automatically
When you use the Services, we automatically collect:
- Device and usage data: IP address, device type and identifiers, operating system, browser type, referring URLs, pages viewed, time spent, and interactions with the Services.
- Location data: Approximate location derived from your IP address. With your permission, we may also collect precise location from your device to show you nearby classes; you can disable this in your device settings at any time.
- Cookies and similar technologies: See Section 5 below.
1.3 Information from Third Parties
- Payment processors: Our payment processor (Stripe, via Stripe Connect) provides us with limited transaction information such as the last four digits of your card, card brand, billing ZIP, transaction status, and payouts to Instructors.
- Single sign-on providers: If you sign in with Google or another SSO provider, we receive basic profile information you authorize that provider to share.
- Public sources and partners: For Instructor verification and trust-and-safety purposes, we may receive information from public records or background-check vendors (where applicable and disclosed at the time of collection).
2. How We Use Your Information
We use the information we collect to:
- Operate, maintain, and improve the Services, including matching Learners with relevant local classes;
- Create and manage your account, authenticate you, and provide customer support;
- Process bookings, payments, and payouts, including via our payment processor;
- Facilitate communication between Learners and Instructors;
- Send you transactional messages (booking confirmations, reminders, receipts, account notices) and, with your consent where required, marketing communications about new classes, features, or local events;
- Personalize your experience and recommend classes near you;
- Maintain the safety and integrity of the Services, including detecting fraud, abuse, and policy violations, and enforcing our Terms of Service;
- Conduct analytics and research to understand how the Services are used and to develop new features;
- Comply with our legal obligations, including tax, accounting, and trust-and-safety requirements.
We do not use information collected from minors for behavioral advertising or to build profiles for marketing purposes.
3. How We Share Your Information
3.1 With Other Users
When you book a class, we share the information necessary to deliver that class. For example:
- Instructors receive:the Learner's first name and last initial, contact information you choose to share through the platform, and any participant details (such as a child's first name and age) you provide to make the class possible.
- Learners see:the Instructor's name, profile, class listings, reviews, and the general location of the class.
Information you post publicly — such as profile photos, public reviews, and class ratings — is visible to other users and may appear in search engine results.
Note for Instructors: Once you receive Learner information through the platform, you act as an independent business and become responsible for handling that information in compliance with applicable privacy laws.
3.2 With Service Providers (Subprocessors)
We share information with third-party service providers who perform services on our behalf, under contracts that limit their use of your information. Each has been evaluated for their security and privacy practices, and we maintain Data Processing Agreements with them where required.

International data transfers: Some of our subprocessors (notably Cloudinary and PostHog) operate infrastructure in the European Economic Area (EEA). Those subprocessors handle any EEA-side data transfers under their own DPAs and applicable transfer mechanisms. LearnNearby is a US-based service and does not independently rely on Standard Contractual Clauses as a data controller subject to GDPR.
Changes to this list: we will notify users at least 30 days before adding new subprocessors. To receive these notifications, email [email protected].
3.3 For Legal and Safety Reasons
We may disclose information when we believe in good faith that disclosure is necessary to:
- Comply with applicable law, regulation, legal process, or governmental request;
- Enforce our Terms of Service or other agreements;
- Detect, prevent, or address fraud, security, or technical issues;
- Protect the rights, property, or safety of LearnNearby, our users, or others.
3.4 In a Business Transaction
If LearnNearby is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such transfer and any resulting changes to this Privacy Policy.
3.5 With Your Consent
We may share information for any other purpose with your consent.
3.6 What We Do Not Do
We do not sell your personal information for money. We also do not "share" your personal information for cross-context behavioral advertising as those terms are defined under California law (see Section 7).
3.7 With Affiliated Services Operated by LearnNearby LLC
LearnNearby LLC may operate additional consumer-facing services under registered DBA brand names other than LearnNearby — currently, these brands (ClubsNearby, SpacesNearby) are not live but may be offered in the future. When LearnNearby LLC launches additional services:
- If you create an account on another LearnNearby LLC brand service, we may recognize you as an existing user and, with your consent, link your accounts to provide a connected experience.
- We will not share your personal information from LearnNearby with another LearnNearby LLC brand service without (a) disclosing the sharing in the applicable privacy policy, and (b) providing you an opportunity to opt out of the linkage where required by law.
- When cross-brand data sharing begins, we will provide at least 30 days' advance notice of the change by email and by updating this Privacy Policy.
For CCPA purposes: sharing of personal information with other services operated under the same legal entity (LearnNearby LLC, including any successor entity after a legal name change) constitutes a "disclosure" to an affiliate. We do not sell or share personal information for cross-context behavioral advertising to or with these affiliated services.
4. Data Retention
We retain personal information for as long as necessary to provide the Services and for the additional periods described below:

You may request deletion of your account at any time (see Section 6). Some information may be retained longer where required by law, to resolve disputes, or to enforce our agreements.
5. Cookies and Similar Technologies
We use cookies, local storage, and similar technologies to operate the Services, remember your preferences, understand usage, and improve performance.
- Strictly necessary cookies are required for the site to function (e.g., authentication, security).
- Functional cookies remember your preferences (e.g., neighborhood, language).
- Analytics cookies help us understand how the Services are used.

6. Your Rights and Choices
Depending on where you live, you may have the right to:
- Access the personal information we hold about you;
- Correct inaccurate information;
- Delete your account and associated personal information;
- Receive a copy of your information in a portable format;
- Object to or restrict certain processing;
- Withdraw consent where processing is based on consent.
To exercise these rights, you can use the controls in your account settings or contact us at [email protected]. We will verify your request before responding, typically by confirming you control the email address on file. We will respond within the time required by applicable law (generally 45 days under California law, with one possible 45-day extension).
You can request a copy of your data or delete your account from your account settings.
You may also:
- Opt out of marketing emails using the unsubscribe link in any marketing message;
- Disable precise location in your device settings;
- Manage cookies through your browser settings.
We will not discriminate against you for exercising your privacy rights.
7. California Privacy Rights (CCPA/CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act.
7.1 Categories of Personal Information We Collect
In the past 12 months, we have collected the following categories of personal information:

7.2 Sale and Sharing
We do not sell personal information for monetary consideration, and we do not share personal information for cross-context behavioral advertising. We do not have actual knowledge that we sell or share the personal information of consumers under 16.
7.3 Your California Rights
You have the right to:
- Know what personal information we collect, use, disclose, and (if applicable) sell or share;
- Delete personal information we have collected from you, subject to legal exceptions;
- Correct inaccurate personal information;
- Opt outof the sale or sharing of personal information (not applicable — we do neither);
- Limitthe use and disclosure of sensitive personal information (not applicable — we do not use sensitive PI for purposes beyond those permitted without an opt-out);
- Non-discrimination for exercising your rights.
To exercise these rights, email [email protected] or use the in-account controls. You may also designate an authorized agent to make a request on your behalf; we will require proof of authorization and may require you to verify your own identity.
Multi-brand rights requests.If LearnNearby LLC operates additional consumer-facing services (under DBA brand names or, after a legal name change, under a successor entity name), your California privacy rights apply to all personal information LearnNearby LLC holds about you regardless of which brand's service you used. You may submit a single rights request to [email protected] (or to the rights-request mechanism of any active LearnNearby LLC brand) to exercise your rights across all LearnNearby LLC services. We will respond to multi-brand requests within the 45-day statutory period, with one possible 45-day extension.

7.4 Shine the Light
California Civil Code § 1798.83 permits California residents to request information regarding our disclosure of personal information to third parties for direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
To make a Shine the Light request, email [email protected] with "Shine the Light Request" in the subject line. We will log and respond to verified requests within 30 days.
7.5 Sensitive Personal Information (CPRA)
Under CPRA, certain categories of personal information are classified as “sensitive personal information” (SPI) and carry enhanced obligations. LearnNearby collects the following SPI categories:
- Account login credentials(username and password) — collected to authenticate you. Used solely for account access and security.
- Precise geolocation— collected from your device only with your explicit permission, and only to show you classes near your current location. You can revoke this permission in your device settings at any time.
- Health and accommodation information— when you book a class on behalf of a minor child, you may provide allergy or accommodation information. This is shared only with the relevant Instructor for the purpose of conducting the class safely and is not used for any other purpose.
- Payment account data— payment card information is collected and processed directly by Stripe, Inc. LearnNearby retains only limited transaction metadata (last four digits, card brand, transaction status). We do not store full card numbers or bank account details.
We use each category of SPI only for the purpose for which it was collected and only to the extent necessary to provide the Services. We do not use SPI for inferring characteristics about you, for behavioral advertising, or for any purpose not listed above. You have the right under CPRA to limit the use and disclosure of your SPI to uses necessary to perform the Services. To exercise this right, contact us at [email protected].
8. Children's Privacy
LearnNearby is intended for users 18 and older. Adults may book classes on behalf of minor children, including children under 13. When you do so:
- You represent that you are the child's parent or legal guardian, or are otherwise authorized to provide information about the child;
- We collect only the limited information needed to deliver the class (typically the child's first name, age, and any safety-relevant information you choose to share, such as allergies);
- We do not create separate accounts for children under 13;
- We do not use children's information for marketing, advertising, profiling, or any purpose beyond delivering the class and protecting child safety;
- The Instructor delivering the class will receive the information necessary to safely teach the child;
- You can review, request changes to, or request deletion of the information we hold about your child by contacting [email protected].
We comply with the Children's Online Privacy Protection Act (COPPA). If you believe we have collected information from a child under 13 without the required parental consent, please contact us immediately and we will promptly delete it.
For California residents, we do not knowingly sell or share the personal information of consumers under 16.
8.1 Consent Mechanism
When a booking on the Platform includes a minor child under 13 years of age, LearnNearby presents the booking parent or legal guardian with a separate consent screen before the booking is confirmed. That screen describes in plain language: (a) what personal information about the child LearnNearby collects; (b) how that information is used; (c) with whom it is shared; and (d) the parent's rights to review, correct, and delete the information. Completion of the booking constitutes the parent's or guardian's consent to those practices.
LearnNearby does not knowingly collect personal information from children under 13 outside of this supervised booking flow. If we learn that we have collected information from a child under 13 without verifiable parental consent, we will delete it promptly.
8.2 Instructor Access to Child Data
When a booking includes a minor child, the Instructor for that class receives the child's name, age, and any health or accommodation information provided during booking. Instructors receive this information solely for the purpose of conducting the class and ensuring participant safety. Instructors may not use child participant data for any other purpose, share it with third parties, or retain it after the class is complete. This obligation is reflected in our Terms of Service and Instructor Agreement.
8.3 Photo and Recording Prohibition
Instructors are prohibited from photographing, video recording, or audio recording any minor participant without prior written consent from that child's parent or guardian, obtained separately from and in addition to the booking consent. Parents who believe this policy has been violated should report it immediately to [email protected]. LearnNearby will investigate promptly and may suspend or remove the Instructor pending investigation.
8.4 Parental Rights
Parents and guardians may, at any time:
- Request access to personal information LearnNearby holds about their child;
- Request correction of inaccurate information;
- Request deletion of their child's information, subject to LearnNearby's legal retention obligations; or
- Refuse further collection or use of their child's information.
To exercise these rights, email [email protected]with "Children's Privacy" in the subject line. We will respond within 30 days.
9. Data Security
We implement administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit (TLS), encryption of sensitive data at rest, access controls, and regular security reviews. Payment card information is handled directly by our PCI-DSS compliant payment processor and does not transit or rest on our servers.
No system is completely secure. If we learn of a security breach affecting your personal information, we will notify you and the appropriate authorities as required by law.
10. International Users
LearnNearby is operated from the United States and the Services are intended for users in the San Francisco Bay Area. We do not knowingly accept registrations from users located outside the United States.
If you access the Services from outside the United States, you understand that your information will be transferred to, processed, and stored in the United States, which may have different data protection laws than your country.
11. Third-Party Links and Services
The Services may contain links to third-party websites, apps, or services that we do not control. This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies before providing them with your information.
12. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email and/or by prominent notice on the Services before the changes take effect. The "Last Updated" date at the top of this policy reflects the most recent revision. Continued use of the Services after the effective date of an update constitutes your acceptance of the revised policy.
13. Additional Services
LearnNearby LLC (or its legal successor by name change) may introduce new platforms, applications, or services under the LearnNearby brand or under new DBA brand names. Each new service will have its own privacy notice or will be covered by an updated version of this Privacy Policy. We will notify you of any material changes to this Policy before they take effect. If a new service collects materially different categories of personal information or uses your information in materially different ways, we will provide a separate privacy disclosure for that service.
